RESOLVE DISPUTES WITH MEDIATION
Russell Surveying Services can offer mediation in a dispute between parties. Since May 1999 when
the new Lord Woolf recommendations on court procedures were implicated, the courts will
encourage independent mediation or arbitration as a means of settling disputes rather than going
through the expensive procedure of employing solicitors in small claims cases of less than £5000,
and any case can be settled by mediation when both parties are willing.
This is an extremely successful, quick and less painful method of settling disputes which will
become more widely used in Jersey as it is in America and on the continent.
Unfortunately, disputes sometimes arise about design matters, quality of materials, workmanship or
contractual situations related to plumbing and central heating installations.
Russell Surveying Services are available to Plumbers, Builders, Property Developers and their
Customers to advise and mediate in issues such as:

It is preferable to avoid such situations in the first place by employing a professional to take care of
your plumbing contracts. However, when there is a dispute, it is best resolved quickly and not
allowed to develop into protracted arguments and counter-arguments leading to litigation. It is
recommended that you take professional advice on the dispute at an early stage.
Initially, Russell Surveying Services would inspect and investigate the problem and prepare a
preliminary report. This will deal with the strengths and weaknesses of the dispute and allow you to
decide on the best way to proceed. Experience shows that a well researched and professionally
presented report in the early stages of a dispute often leads to a quicker resolution, avoiding the
need for court action.

Should the matter proceed further, we are able to collect evidence, advise your Advocate, prepare a
full report and present this to the courts should this be required.
Fees for such services vary according to the nature of the dispute, and the extent of services
required. We can usually agree a fixed fee for the initial advice and report.
